These Terms of Use govern the use of the Vital Cycle Calendar mobile application and related services provided by GradexSoft. These Terms are intended for use as a custom Terms of Use document for the app and should be reviewed by a qualified lawyer before publication or submission to Apple. Apps distributed through the App Store are licensed, not sold, and Apple applies its standard EULA unless a valid custom EULA is provided.[1][2]
1. Acceptance of Terms
By downloading, accessing, or using Vital Cycle Calendar, the user agrees to these Terms of Use and the applicable Privacy Policy. If the user does not agree, the user must not use the app.[1][3]
2. Provider Information
Vital Cycle Calendar is provided by GradexSoft (the “Provider”). The app is intended to help users record, view, and manage menstrual cycle and related wellness information. The Provider should insert its full legal name, registered address, contact email, and any company identification details before publishing this document.
3. Medical Disclaimer
Vital Cycle Calendar is an informational and self-tracking tool only. It does not provide medical advice, diagnosis, treatment, contraception guarantees, fertility guarantees, or emergency services. Users should seek advice from a licensed healthcare professional for any medical concerns or treatment decisions.
4. Eligibility
The app is intended only for users who are legally permitted to use digital services under the laws of their country or region. If the user is under the age required to enter a binding agreement, the app may only be used with the consent of a parent or legal guardian.
5. License to Use the App
Subject to compliance with these Terms, the Provider grants the user a limited, non-exclusive, non-transferable, revocable license to install and use Vital Cycle Calendar for personal, non-commercial purposes on devices the user owns or controls. This license is subject to any applicable App Store usage rules and must not conflict with Apple’s platform rules.[1][4][5]
6. Subscription Terms
Certain features of Vital Cycle Calendar may be offered through auto-renewable subscriptions. The applicable subscription title, billing period, and price are displayed in the app before purchase, as required for auto-renewable subscriptions on the App Store.[6][7]
Subscription payments are charged to the user’s Apple ID account after purchase confirmation. Unless canceled at least 24 hours before the end of the current billing period, the subscription renews automatically. The account is charged for renewal within 24 hours before the end of the current period, at the price presented in the purchase flow or otherwise communicated by Apple.
Users can manage or cancel subscriptions in their Apple account settings after purchase. Deleting the app does not automatically cancel a subscription. To the extent required by applicable law, refunds are handled by Apple or the relevant platform operator unless stated otherwise in mandatory local law.
7. Acceptable Use
The user agrees not to:
- use the app for unlawful, fraudulent, or abusive purposes;
- interfere with the operation, security, or integrity of the app;
- attempt to reverse engineer, decompile, or modify the app except where such restriction is prohibited by applicable law;
- use the app to infringe intellectual property, privacy, or other rights of third parties;
- misuse any cycle or health-related outputs as a substitute for professional medical advice.
8. User Content and Data
The user is responsible for information entered into the app, such as cycle records, symptoms, notes, reminders, and related entries. The user represents that any information provided through the app is lawful and does not violate the rights of others.
The Provider’s handling of personal data is described in the Privacy Policy. By using the app, the user acknowledges that health-related or cycle-related data may be sensitive personal data under applicable law and should review the Privacy Policy carefully.
9. Availability and Changes
The Provider may update, modify, suspend, or discontinue any part of the app at any time, including features, technical requirements, or subscription offerings. The Provider does not guarantee that the app will always be available, uninterrupted, secure, or error-free.
10. Intellectual Property
The app, including its software, design, text, graphics, trademarks, and related materials, is owned by or licensed to the Provider and protected by applicable intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to the user.[1][3]
11. Termination
These Terms remain in effect until terminated. The user may stop using the app at any time. The Provider may suspend or terminate access to the app, with or without notice, if the user violates these Terms, creates legal risk, abuses the service, or where required for security, maintenance, or legal compliance.
12. Disclaimers
To the maximum extent permitted by law, Vital Cycle Calendar is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. The Provider does not warrant that the app will be accurate, reliable, complete, uninterrupted, secure, or free from defects. Apple’s standard EULA also states that licensed applications may be provided without warranty except where warranty cannot be disclaimed under law.[1]
13. Limitation of Liability
To the fullest extent permitted by applicable law, the Provider is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, health-related decisions, business interruption, or lost profits arising from or related to the use of the app. Where liability cannot be excluded, it is limited to the amount paid by the user for the app or subscription during the 12 months preceding the claim, or the minimum amount required by law.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer protection rights.
14. Apple App Store Notice
If the app is accessed through Apple’s App Store, the user acknowledges that these Terms are concluded between the user and the Provider, and not with Apple. The Provider, not Apple, is solely responsible for the app and its content, except to the extent otherwise required by Apple’s standard terms and applicable law. Any use of the app must comply with the App Store terms and usage rules.[1][4]
15. Governing Law
These Terms are governed by the laws of the country in which the Provider is established, unless mandatory consumer protection laws in the user’s place of residence provide otherwise. The Provider should insert the specific governing law and dispute forum before publication.
16. Changes to These Terms
The Provider may revise these Terms from time to time. The updated version becomes effective when published in the app or on the Provider’s website, unless a later date is stated. Continued use of the app after the effective date of updated Terms constitutes acceptance of the revised Terms.

18. App Store Links
For App Store review and in-app compliance, the app should present a functional link to the Privacy Policy and a functional link to the Terms of Use / EULA in the subscription purchase flow. If the Apple standard EULA is used instead of this custom document, Apple says the standard EULA link should be included in the App Description or a custom agreement should be added in App Store Connect.[6][2][7]
